We are registered under the Data Protection Act 1998 (“the DPA”) and any personal data collected when you use this website will be dealt with in accordance with the DPA. We are committed to protecting your privacy. Only authorised employees within the company are permitted to use any information collected from you. Parliament has created specific offences for unauthorised actions against computer systems and data. We will investigate any such actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

We operate an ‘opt in’ policy for customers wishing to receive information on forthcoming events and store offers.

If you have opted in to receive information from us or any of our directly or indirectly related entities we may use your personal information to notify you about important changes to the site, new services we will be providing, events, articles or other information we think will be of interest to you.

Severance
 If any term is held to be invalid, unlawful or unenforceable, it shall not affect the enforceability of any of the remaining terms which shall remain in full force and effect.

 The terms and conditions contained herein shall be governed by and construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English courts.

1. ORGANISATION

SPAYCIAL (hereinafter referred to as “Spaycial”), a french Société par Actions Simplifiée (SAS) with a capital of €40,862.00, having its registered office at 86 rue du Faubourg Saint Denis – 75010 Paris, registered with the Paris Trade and Companies Register under no. 822 619 185, registered with the french Autorité de Contrôle Prudentiel et de Résolution under no. 76254, is organising a Cashback*(*refund) Offer (hereinafter referred to as the Offer or “Cashback Offer”) for members of the loyalty programme (hereinafter referred to as “Users” or “Members”). The terms and conditions of this operation are set out below.

2. CONDITIONS OF PARTICIPATION

Every time you accumulate £40 spend at eligible locations at Liverpool ONE (Aether, Auntie Anne’s, Bar Burrito, Bean Coffee, Bem Brasil, Bierkeller, Bills, Black Sheep Coffee, Bread Street Kitchen, Browns, Byron Burger, Caffe Nero Lord St, Caffe Nero Peter’s Lane, Chopstix, Cosmo, Costa Coffee, Cosy Club, Cote, Escape Live, Five Guys, GBK, Greggs Lord St, Greggs Wall St, Heavenly Desserts, Hotel Chocolat, Junkyard Golf, Krispy Kreme, Las Iguanas, Level Tap, Lunya, Maggie Fu, Mamasan, Mooboo, My Cookie Dough, Nandos, Odeon, On The Green, Pizza Express, Pizza Hut, Pret, Manger, Roxy Ballroom, Sblended, Slim Chickens, Smoke & Dough, Starbucks Paradise St, Starbucks South John St, Subway, TGI Friday, The Club House, Tortilla, Turtle Bay, Wagamama, Wok & Go, Yo Sushi, Zizzi), you will receive £1.25 cash back reward. There is a maximum of £25 cash back per user until 31 December 2023. We reserve the rights to withdraw any cash back rewards offers at any given time. Any cash back rewards unlocked until the day the offer is withdrawn will still be paid as soon as possible and at the latest within one month.

Winnings shall be reimbursed to the User as soon as possible and at the latest within one month of the availability of the Offer. Users who are eligible for cashback and who receive a refund of their payment within the above-mentioned limits undertake to provide SPAYCIAL, on request, with all the information necessary to verify their identity and transactions. They attest to the veracity of all the information they provide and authorise all legal verifications concerning the information provided. Any information that is incomplete, false, erroneous, illegible, unusable and/or does not correspond to what was declared when registering for the Loyalty Programme will result in the nullity of the participation and the loss of the benefit of its refund. We reserve the right to withdraw any cash back reward offers at any given time. They also have the right to object to the processing of their personal data, without giving any reason in the case of commercial canvassing (including by post and telephone), or to justify a particular situation in other cases, or to request a limitation of the said processing. It is also possible to request the communication of personal data in a structured and standard format. Finally, the Participant has the right to define directives concerning the fate of your personal data after his death. This offer is valid from 16 July 2023 to 30 September 2023.

This Cashback Offer is only available to Members who meet the following cumulative characteristics and criteria:
